Survey of Land and Real Estate Transactions in the Russian Federation

The survey of businesses’ access to land and real estate in 15 regions of the Russian Federation was carried out by FIAS at the request of the RF Ministry of Economic Development and Trade and the Federal Antimonopoly Service. The report includes measurement of the governance and public services delivery quality with regard to key public agencies and formal procedures, which businesses must comply with. The project received financial support from the European Union, the Swiss State Secretariat for Economic Affairs (seco), and FIAS (the World Bank Group).

The report is the product of a program of cooperation between FIAS and the Russian Federation Ministry of Economic Development and Trade under a grant from the European Union. The main subjects of cooperation were urban land reform, in particular improving access to land for small and medium enterprises; the role of the anti-competition laws in addressing business land issues; and development of a system for MEDT to monitor developments in land reform over time. This report summarizes only the conclusions and recommendations on the urban land issues and business access to land.

This brief report contains analysis of two large-scale surveys of administrative barriers to investment and business development conducted by FIAS in 2004 and by the Rostov Oblast Administration in 2007. It reveals that business see government organizations as partner more often; bureaucratic procedures became less problematic; corruption stopped to be perceived as ‘big problem’; frequency and coverage by inspections decreased, inspections became more structured; tax administration decreased; at the same time business more often pays bribes during inspection, also business criticize supervision bodies more.

The current research is one of the first attempts to analyze the cost and results of CSR and forest certification particularly. The research has demonstrated some possibilities for Government of Russia for removing administrative barriers and improving conditions for developing market driven CSR in forest industry. This experience can be adopted in other branches of economy. The goal of the project is to analyze voluntary forestry certification in Russia, given progress to date, and consider the potential consequences for the market-based voluntary certification and/or CSR reporting in other industry sectors. This experience can be adapted for the use in other industries. The project was held with financial support of the European Union and FIAS.

Surveys of existing businesses cannot take account of firms who failed to start or were discouraged to start in a particular location due to administrative or other barriers. FIAS piloted a survey of "potential investors" with a special survey instrument targeted at investors who have shown some interest in a particular location, but did not invest there. The survey was conducted in the Veliky Novgorod Oblast, Kaliningrad Oblast, and Tomsk Oblast.

Doing Business in Russia 2009

Doing Business in Russia 2009 is the first sub-national report for Russian in the Doing Business series, initially launched in 2003. It compares business regulations across 10 Russian cities in four key areas: starting a business, dealing with construction permits, registering property, and trading across borders. These indicators capture local legislation or practice. The report shows that differences in regulations and practices -- or in the implementation of national-level regulations -- can enhance or constrain local business activity. It suggests that Russian cities can rapidly improve competitiveness by adopting good practices already in place elsewhere in the country.

This paper analyzes land transactions between municipalities and private businesses, based on official data and on business surveys in 15 regions of the Russian Federation. Since the Russian Federation passed the new land Code in 2001, land privatization has been officially encourages by the federal government and in particular, land under previously privatized buildings was supposed to be privatized to the owner at a nominal price. The paper shows that many sub-national authorities (which own or control the vast majority of land of interest to businesses) appear to use a combination of high statutory land buy-out prices and administrative barriers to deter land privatization and to offer “long-term leases” (which are not bully marketable) instead. On the other hand, regions that have established low buy-out prices and taken steps to remove unnecessary administrative barriers to land privatization appear to have higher rates of land ownership by businesses, and to face lower levels of corruption in the privatization process. The paper concludes that further reductions in the statutory prices for privatization of land under buildings and elimination of unnecessary administrative barriers should help to encourage further land privatization and the development of a competitive, secondary market in commercial land.
