Bar Associations

 

Bar associations regulate the legal profession through entrance requirements, maintain a disciplinary system, conduct training for its members, and provide legal services to the community. The bar is a critical legal and judicial system interest group and is responsible for promoting the rule of law and is critical to most reforms. The quality of legal services impacts the protection of citizen rights, judicial effectiveness and efficiency, and business transaction costs.

Regulating the conduct of lawyers ensures quality, transparency and independence. Rules of conduct affect professional competition, and ethical rules protect client and societal interests. Such rules address professional dignity, consumer protection, confidentiality and clients’ rights. A critical element of these rules is conflict of interests. Lawyers must be held accountable for their professional misconduct by transparent disciplinary procedures and mechanisms to allow client claims for damages related to poor quality services. The regulation of fees should provide certainty to lawyers and clients while at the same time provide a basis for the courts to determine necessary costs of litigation.
