Judicial Training

 

Judicial independence requires a well trained and educated judiciary. A judiciary must often address delicate issues concerning liberty, property, and access to public services. Judges must be well-prepared. In many countries judges are personally responsible for developing their knowledge and skills. Although some seminars are offered, they are not done so systematically. More recently continuing education is seen as a judicial responsibility and a common element of legal and judicial reform programs.

Judicial training includes a variety of subjects designed not only to improve knowledge, but also change attitudes. In some countries, training assists judiciaries develop into an impartial independent dispute resolution mechanism. In other countries, judicial education emphasizes attitudinal change to improve judicial integrity or eliminate hidden bias on gender or ethnic issues. Regardless of course type, managing this training is critical. Some countries have adopted the view that the overall control and direction of judicial training must be in the judiciary’s hands. In other countries, training is provided by separate entities such as law schools or judicial training institutes managed by the Ministry of Justice.


The Role of Judicial Education, Training, and Accountability in Shaping Legal Culture and Practice

Australian Law Reform Commission

When the Australian Law Reform Commission (ALRC) began its evaluation of the Australian judiciary, they saw legal education as peripheral to their inquiry. By the end of their research, they found that education, training, and accountability were critical to shaping the "legal culture" and thus the operation of the legal system. This link accesses the second chapter of the ALRC's final report, in which they draw on their review of Australia's changing needs in judicial education and comparative experience in Canada and the United States to make general recommendations for legal education, judicial education, ongoing training, and accountability.

Educating Judges: The French Approach

Judges in France are recruited directly from university then subjected to a rigorous training involving some class room instruction and work in courts and law offices. Throughout their career, French judges are eligible for further training. Evaluation of Judicial Training in France and in Europe
 

In 2008, the French National Magistrate's School or ENM (Ecole Nationale de la Magistrature) evaluated the judicial training it provides and tried to put this into a European perspective by looking at experiences in other countries such as Germany, England & Wales, Spain, Italy, and the Netherlands. It undertook an empirical study based on replies to a questionnaire addressed to three gnerations of magistrates interviewed about different aspects of their education and their human relations at work. It also identifies the need at European level to develop a Judicial Education Assessment Toolkit (JEAT), an initiative taken up by the European Commission for the Efficiency of Justice (CEPEJ) at the Council of Europe.
